ARMS LICENCES SCAM: MHA seeks more time to take decision on prosecution sanction against IAS officers named in FIR

In the much Publicised Arms Licences Scam, the Ministry of Home Affairs (MHA), Govt. of India in its fresh Affidavit filed on 07.10.2025 before the Jammu Wing of the High Court of J&K and Ladakh in PIL No.09/2012 titled Sheikh Mohd. Shafi & Anr. V/s Union of India & Anr. has divulged that pursuant to Division Bench order dated 07.08.2025, the MHA convened a meeting under the Chairmanship of Addl. Secretary (UT) on 27.08.2025 with the officials of Govt. of J&K and CBI to discuss the CBI’s proposal for grant of sanction for Prosecution against the IAS Officers named in CBI FIR Nos. RCCHG0512018S0006 and RCCHG0512018S0007. The submissions of the Govt. of J&K and CBI in the meeting were taken into cognizance and after examining the overall facts of the case, it was decided by MHA to seek certain clarifications from CBI/J&K Administration to enable MHA to take a decision regarding grant of Sanstion of Prosecution (SoP) or otherwise against the accused officers. 

The MHA’s Affidavit filed through CGSC Eishan Dadhichi and settled by Sr. Advocate Vishal Sharma, DSGI further discloses that MHA has accordingly flashed letters dated 01.09.2025 thereby seeking clarifications from the CBI and the J&K Administration and in response Govt. of J&K vide letter dated 26.09.2025 forwarded their comments, however, response from the CBI is awaited. The Affidavit further says that after receiving the comments of CBI, the proposal shall be examined and an appropriate decision will be taken.

        When this PIL of wide Public Importance came up for hearing before the Division Bench of the High Court of Jammu & Kashmir and Ladakh (though Virtual Mode) comprising Chief Justice Arun Palli and Justice Rajnesh Oswal, DSGI Vishal Sharma, Sr. Advocate with CGSC Eishan Dadhichi appearing for MHA submitted that a fresh Affidavit on behalf of MHA, GOI has been filed but the same was not on record and owing to some objections the same has not been cleared by the office and for this reason the matter was adjourned to 20.11.2025. 

Advocate S.S.Ahmed with Advocate Supriya Chouhan appeared for the petitioner whereas Sr. AAG Mohsin S. Qadri with Assisting Counsel Maha Majeed appeared for Govt. of J&K.
