CAT imposes additional costs on Financial Commissioner & DG (codes) finance department
Despite 16 adjournments by the Court No.1 of the Central Administrative Tribunal Jammu, in case no. O.A./1446/2024 (Jammu) the officers of the Finance department, J&K Govt, who are respondent no. 3 (Financial Commissioner, Finance Department) and respondent no. 4 (Director General, Codes, Finance Department) have failed to file their reply.
In order dated 05/06/2026, Hon’ble Pragya Sahay Saksena, Member (A) and Hon’ble Sanjeev Gupta Member (J), observed that, on 13.05.2026, at the request of Mr. Rajesh Thapa, learned A.A.G., Respondents No. 3 & 4 were granted further two week’s time to file reply subject to payment of cost of Rs. 5000/- to be deposited in Advocate’s Welfare Fund of High Court of J&K and file receipt of the same.
“Today, Mr. Rajesh Thapa, learned A.A.G. prays for further two weeks time to file reply.
Learned A.A.G. may file reply on behalf of Respondents No. 3 & 4, subject to payment of cost of Rs. 5000/-, in addition to the cost imposed earlier, to be deposited in Advocate’s Welfare Fund of High Court of J&K and receipt of the same be filed on the next date of hearing”, the CAT ordered.

It is pertinent to mention that Department of Law, Justice and Parliamentary Affairs, Govt. of J&K, vide circular No. 08-JK(LD) of 2026 Dated: 12–05-2026, issued instruction regarding timely filing of objections /replies/ Counter Affidavits, LPAs / Writ Petitions/ SLPs before the Hon’ble Supreme Court, the Hon’ble High Court of Jammu and Kashmir & Ladakh and the Central Administrative Tribunal (CAT) and strict adherence to Instruction thereof. These instructions were in reference to order dated 22.04.2026 and 05.05.2026 passed by Hon’ble High Court of Jammu and Kashmir & Ladakh in WP(C) No. 1618/2023 titled Ali Mohammad Wani vs.UT of JK and Ors.
