Roshni Scam: J&K revenue authorities not cooperating, next hearing on Sept 6

Revenue authorities of the Union Territory of Jammu and Kashmir are not showing any cooperation towards the ongoing investigation into the Roshni land scam. This was was informed to the Division Bench of High Court comprising Chief Justice Pankaj Mithal and Justice Puneet Gupta by Central Bureau of Investigation (CBI).

It was further informed that CBI has filed 17 FIRs into the Roshni Scam and probe has been completed in four cases. Though repeated requests about furnishing of records and information have been made but have not been taken seriously.

Though the Advocate General DC Raina denied the same yet the CBI counsel reiterated the same and submitted that this has also been mentioned in the status report dated June 16, 2021. Chief Justice asked the Advocate General to provide the details to the court about the steps taken by the J&K Government to implement the earlier directions of the Division Bench. Advocate General said “The Government has cancelled all the mutations made under the Roshni Act”.

The Chief Justice further asked that whether the possession of the land after cancellation of mutations have been taken. Advocate General said “the Government has taken over the open land but no coercive action has been taken in the light of the statement made before the Supreme Court”.

On October 9, 2020, the J&K High Court had directed the Central Bureau of Investigation (CBI) to take over the investigation of the Roshni land scam in J&K and Court declared all allotments made under the legislation void from the beginning.

The Division bench directed the Advocate General to prepare a synopsis in a tabulated form concerning each of the review petitions in two sets, those filed up to January 28, 2021 and those filed thereafter.

The High Court of J&K and Ladakh has now fixed the next hearing on September 6, 2021, to hear review petitions and other applications filed in Rs 25,000-crore Roshni land scam.
