ACB recommends action against official involved in fake certificate scandal

Anti-Corruption Bureau (ACB) has recommended that Regular Departmental Action (RDA) should be initiated against a former blue-eyed Legislative Council official who was promoted in violation of rules as he was having a fake Date of Birth (DOB) document.

ACB has also recommended that departmental action must be initiated against other in-service officers/officials who were engaged in this scandal.

Enquiry report and further communiqué received by Commissioner/Secretary to Government General Administrative Department mentions that the ACB has provided pointwise details of the enquiry of allegations. Most of these allegations are found to be accurate.

ACB revealed that the appointment of official as a reporter in J&K Legislative Council and his further promotion to the rank of Special Secretary was done while violating relevant laws, rules and regulations of appointment and promotions. Legislative Council Secretariat, recruitment and conditions of Service Rules 1959 were also blatantly violated in this process.

ACB also includes that the Date of Birth which was provided by the official was found to be fake and forged during enquiry. When he should be strictly punished for this scandal, he was just asked to produce a genuine certificate (which shows LC’s lenient behaviour towards official). Amount spent on the official’s salary amounts to a large sum and is a huge financial burden on the department.

Report also mentions that investigation done so far shows that he was promoted from non-gazetted to gazetted rank in violation of service rules governing appointment and promotions. He gradually surpassed his senior colleagues whose rank was downgraded without any justification. This shows that favouritism plays an important role in management of promotions. Those officials who were involved in this scandal must be punished.

ACB has recommended GAD to initiate Regular Departmental Action (RDA) against the accused for service misconduct.
